Cooley MINNEAPOLIS: FORTRESS PRESS, 2014. 318 PP. $34.00In The Ethics of Death, religious studies scholar Lloyd Steffen and philosopher Dennis Cooley offer ethical analysis of a variety of topics with an approach they (...) refer to as "dialogic engagement," modeled upon their own interdisciplinary exchange with one another (4). In fact, each of the seven main chapters is explicitly structured as a dialogue: each author laying out his particular approach in two separate sections, which are then followed by a question-and-answer section where the authors pose questions to one another and provide brief responses. Intending to address death as it relates to the moral lives of the living, the chapters cover topics that are of enduring interest to students, scholars, and the general public: abortion, the death penalty, war, suicide, physician-assisted suicide, and euthanasia. To distinguish it from other recent titles that explore the dying experience in contemporary medical contexts, the book might be more accurately described as addressing the ethics of killing. [End Page 218]To set the stage for subsequent topical chapters, the book's first chapter provides a basic introduction to ethics, including outlining prominent ethical theories such as Kantian, utilitarian, virtue, and natural law approaches. Readers will find clear descriptions of key terms such as consequentialism, deontology, and pragmatism. In his section Steffen also addresses the contrast between religious and secular ethics, noting how religious ethical traditions are potentially distinctive (such as divine command theories or use of sacred texts) and potentially overlapping (such as similar practical judgments). In this chapter, the authors also indicate their own preferred normative approach: Steffen identifying with a "natural law hybrid ethic," a natural law approach that "allows the other ethical theories a part but says none has the final say" (22), and Cooley advocating what he calls the "Pragmatic Principle" approach, combining what he considers plausible and helpful from both deontology and consequentialism (32–33). The authors' normative approaches reveal the strengths and limitations of various ethical theories, and the practical usefulness of theoretical hybridity.Each of the topical chapters provides readers with relevant background information, such as the legal and policy history of particular issues. Given the flexible normative approaches taken by the authors, not surprisingly each chapter provides a nonabsolutist position on each form of killing (although Cooley's evaluation of war is strongly negative: "Some may be justified, whereas the vast majority cannot be" [165]). The chapters also provide balanced, thoughtful sections that outline major arguments on opposite sides of ethical debate, sometimes in the form of enumerated "for and against" lists. The chapters thus familiarize readers with important dimensions of contemporary debates, such as just war theory, pacifism, human rights theory, definitions of personhood, and the determination of medical futility. Chapters include useful references to thinkers who have shaped ethical debate such as Don Marquis and Judith Thompson on abortion and Mahatma Gandhi and Douglas Lackey on war and violence. Students of religious ethics will find the sections by Steffen particularly helpful in reviewing various ethical positions from religions such as Buddhism, Islam, Christianity, and Judaism.The book could certainly be effective in a topical survey course at the undergraduate or graduate level, with a major strength that the book's structure illustrates theoretical connections between philosophy and religious studies regarding ethical inquiry. The dialogue questions that conclude each chapter could be used to frame class discussion or even as prompts for student writing assignments. However, for a course focused on comparative religious ethics, instructors would want to supplement with more in-depth ethical analysis from particular religious ethical traditions. At the invitation of the Editors, we wrote an article (entitled, “Minds, Brains, and Norms”) detailing our views on a variety of claims by those arguing for the explanatory power of neuroscience in matters of law and ethics. The Editors invited comments on our article from four distinguished academics (Walter Glannon, Carl Craver, Sarah Robins, and Thomas Nadelhoffer) and invited our reply to their critique of our views. In this reply to our commentators, we correct some potential misunderstandings of (...) our views and further clarify our positions with discussions of the conceptual-empirical distinction, rule-following, explanations at the personal and subpersonal levels, memory, and lie detection. Although we acknowledge many of the criticisms advanced by our distinguished colleagues, we conclude that, in several important respects, their criticisms confirm the points made in our original article. It is commonly assumed that when we assign different credences to a proposition, a perfect compromise between our opinions simply ‘splits the difference’ between our credences. I introduce and defend an alternative account, namely that a perfect compromise maximizes the average of the expected epistemic values that we each assign to alternative credences in the disputed proposition. I compare the compromise strategy I introduce with the traditional strategy of compromising by splitting the difference, and I argue that my strategy is (...) a reasonable characterization of epistemic compromise. Top-down feedback does not benefit speech recognition; on the contrary, it can hinder it. No experimental data imply that feedback loops are required for speech recognition. Feedback is accordingly unnecessary and spoken word recognition is modular. To defend this thesis, we analyse lexical involvement in phonemic decision making. TRACE (McClelland & Elman 1986), a model with feedback from the lexicon to prelexical processes, is unable to account for all the available data on phonemic decision making. The modular Race model (Cutler (...) & Norris 1979) is likewise challenged by some recent results, however. We therefore present a new modular model of phonemic decision making, the Merge model. In Merge, information flows from prelexical processes to the lexicon without feedback. Because phonemic decisions are based on the merging of prelexical and lexical information, Merge correctly predicts lexical involvement in phonemic decisions in both words and nonwords. Computer simulations show how Merge is able to account for the data through a process of competition between lexical hypotheses. We discuss the issue of feedback in other areas of language processing and conclude that modular models are particularly well suited to the problems and constraints of speech recognition. Refinements in Darwin’s theory of the origin of a moral sense create a framework equipped to organize and integrate contemporary theory and research on morality. Morality originated in deferential, cooperative, and altruistic ‘‘social instincts,’’ or decision-making strategies, that enabled early humans to maximize their gains from social living and resolve their conflicts of interest in adaptive ways. Moral judgments, moral norms, and conscience originated from strategic interactions among members of groups who experienced confluences and conflicts of interest. Moral argumentation buttressed (...) by moral reasoning is equipped to generate universal and impartial moral standards. Moral beliefs and standards are products of automatic and controlled information-processing and decision making mechanisms. To understand how people make moral decisions, we must understand how early evolved mechanisms in the old brain and recently evolved mechanisms in the new brain are activated and how they interact. Understanding what a sense of morality is for helps us understand what it is. (shrink)

This study investigates the market reaction to corporate press releases announcing donations to the relief effort following the December, 2004 tsunami in Southeast Asia. Based on a sample of 79 U.S. companies, results indicate a statistically significant positive 5-day cumulative abnormal return. While differences in the timing of the press releases do not appear to have influenced market reactions, the amount of the donations did. Overall, the results appear to support Godfrey’s (Academy of Management Review 30, 777–798; 2005) assertion that (...) philanthropic giving must be perceived as being a genuine manifestation of the firm’s underlying social responsiveness in order to increase firm value. Dennis Schulting offers a thoroughgoing, analytic account of the first half of the Transcendental Deduction of the Categories in the B-edition of Kant's Critique of Pure Reason that is different from existing interpretations in at least one important aspect: its central claim is that each of the 12 categories is wholly derivable from the principle of apperception, which goes against the current view that the Deduction is not a proof in a strict philosophical sense and the standard reading that (...) in the Deduction Kant only gives an account of the global applicability of the categories to experience. This novel approach enables a reappraisal of Kant's controversial claim that transcendental self-consciousness is not only a necessary condition of objective experience but also sufficient for it. The book provides an extensive analysis of Kant's theory of transcendental apperception and also explains why the argument of the Transcendental Deduction is both a regressive and a progressive argument. Aristotle connects modality and time in ways strange and perplexing to modern readers. In this book the author proposes a new solution to this exegetical problem. Although primarily expository, this work explores topics of central concern for current investigations into causality, time, and change.

An investigation into Aristotle's metaphysics of nature as expounded in the Physics. It focuses in particular his conception of change, a concept which is shown to possess a unique metaphysical structure, with implications that should engage the attention of contemporary analysis. First published in hardback in 1982, the book is now available for the first time in paperback. 'A powerful and appealing explanatory scheme which succeeds on the whole in drawing together a great many seemingly disparate elements in the Physics (...) into a neat unitary stucture.' Background Current requirements for ethical research in Canada, specifically the standard of active or signed parental consent, can leave Indigenous children and youth with inequitable access to research opportunities or health screening. Our objective was to examine the literature to identify culturally safe research consent processes that respect the rights of Indigenous children, the rights and responsibilities of parents or caregivers, and community protocols. Methods We followed PRISMA guidelines and Arksey and O’Malley’s approach for charting and synthesizing evidence. We searched (...) MEDLINE, PsycINFO, ERIC, CINAHL, Google Scholar, Web of Science, Informit Indigenous Collection, Bibliography of Native North Americans, and Sociological Abstracts. We included peer-reviewed primary and theoretical research articles written in English from January 1, 2000, to March 31, 2022, examining Indigenous approaches for obtaining informed consent from parents, families, children, or youth. Eligible records were uploaded to Covidence for title and abstract screening. We appraised the findings using a Two-Eyed Seeing approach. These findings were inductively coded using NVivo 12 and analyzed thematically. Results We identified 2,984 records and 11 eligible studies were included after screening. Three key recommendations emerged: addressing tensions in the ethics of consent, embracing wise practices, and using relational approaches to consent. Tensions in consent concerned Research Ethics Board consent requirements that fall short of protecting Indigenous children and communities when culturally incongruent. Wise practices included allowing parents and children to consent together, land-based consenting, and involving communities in decision-making. Using relational approaches to consent embodied community engagement and relationship building while acknowledging consent for Indigenous children cannot be obtained in isolation from family and community. Conclusions Very few studies discussed obtaining child consent in Indigenous communities. While Indigenous communities are not a monolith, the literature identified a need for community-driven, decolonized consent processes prioritizing Indigenous values and protocols. Further research is needed to examine nuances of Indigenized consent processes and determine how to operationalize them, enabling culturally appropriate, equitable access to research and services for all Indigenous children. Classroom discussion practices that can lead to reasoned participation by all students are presented and described by the authors. Their research emphasizes the careful orchestration of talk and tasks in academic learning. Parallels are drawn to the philosophical work on deliberative discourse and the fundamental goal of equipping all students to participate in academically productive talk. These practices, termed Accountable TalkSM, emphasize the forms and norms of discourse that support and promote equity and access to rigorous academic learning. They have (...) been shown to result in academic achievement for diverse populations of students. The authors outline Accountable Talk as encompassing three broad dimensions: one, accountability to the learning community, in which participants listen to and build their contributions in response to those of others; two, accountability to accepted standards of reasoning, talk that emphasizes logical connections and the drawing of reasonable conclusions; and, three, accountability to knowledge, talk that is based explicitly on facts, written texts, or other public information. With more than fifteen years research into Accountable Talk applications across a wide range of classrooms and grade levels, the authors detail the challenges and limitations of contexts in which discourse norms are not shared by all members of the classroom community. Rather than focusing on the legal and political questions that surround genocidal rape, in this paper I treat a vital area of inquiry that has received much less attention: the moral significance of genocidal rape. My aim is to augment existing moral accounts of rape in order to address the specific contexts of genocidal rape. I move beyond understanding rape primarily as a violation of an individual's interests or agential abilities. The account I offer builds on these approaches (as well (...) as on a pluralist approach), by arguing that rape, as a moral injury, negatively affects the very human dignity of victims. My account also emphasizes the relational harm that marks genocidal rape. (shrink)

Ronald Dworkin famously argued that legal positivism is a defective account of law because it has no account of Theoretical Disagreement. In this article I argue that legal positivism—as advanced by H.L.A. Hart—does not need an account of Theoretical Disagreement. Legal positivism does, however, need a plausible account of interpretation in law. I provide such an account in this article.

Hong Kong is undergoing two overlapping crises: social unrest over anti-government protests, and COVID-19. The media has linked these events in both objective and subjective ways. While some liken the social unrest to COVID-19, others do the opposite. This is an intriguing real-world instance of source-target reversibility with interchangeable source and target resulting in two apt variants. This paper reports a survey study of the links between crisis perceptions and the aptness of metaphor variants. Participants (N = 93) rated 30 (...) matched items on the effects of both crises on trust in governance, interpersonal relations, the economy, physical/mental health, and Hong Kong’s future. This determined, for each participant, a correlation coefficient reflecting perceived structural similarity, and absolute/raw difference scores reflecting perceived substantive similarity of the crises. They then explained which (or neither) of two constructed headlines depicting the SOCIAL UNREST as COVID-19 or COVID-19 as the SOCIAL UNRESTwas more apt. Logistic regression analyses showed that i) metaphor aptness was predictable from structural but not substantive similarity, and ii) the worse crisis was preferred as source domain, but only for its more experientially concrete aspects. The study exemplifies socio-culturally situated’ theoretical investigation and how metaphor research can shed light on crisis perceptions. (shrink)

It is often claimed that relativity theory falls short of giving an account of 'the flow of time' and 'the arrow of time'. Some claim that hence either one or both of these concepts do not correspond to objective reality, others infer that relativity theory is wrongfully 'spatialising' time. I investigate of our normal conception of time is enduring in relativity, even in the absence of a clear representation of flow. It is shown that the conformal structure of spacetime allows (...) for a clear distinction between past, present and future, and that the class of temporally orientable spacetimes allows for an 'arrow of time'. Finally, I briefly discuss the class of Friedmann universes, to which our universe seems to belong, and which is indeed temporally orientable. German Es wird häufig behauptet, dass die Relativitätstheorie keine adäquate Beschreibung des , Zeitflusses' und des , Zeitpfeils' enthalte. Einige ziehen daraus die Schlussfolgerung, dass beiden Konzepten nichts in der objektiven Realität entspreche, andere ziehen den Schluss, dass die Relativitätstheorie die Zeit fälschlicherweise , verräumliche'. Ich untersuche, wie viel von unserer althergebrachten Zeitvorstellung in der Relativitätstheorie überdauert, selbst in der Abwesenheit einer klaren Repräsentation von , Zeitfluss'. Ich zeige, dass die konforme Struktur der Raumzeit eine klare Unterscheidung von Vergangenheit, Gegenwart und Zukunft erlaubt, und dass die Klasse der zeitlich orientierbaren Raumzeiten die Repräsentation einer , Zeitpfeils' durchaus erlaubt. Schließlich diskutiere ich kurz die Klasse der Friedmann Raumzeiten, zu welcher unser Universum zu gehören scheint, und welches tatsächlich zeitlich orientierbar ist. (shrink)

Abstract In this paper I criticise a recent account of fictional discourse proposed by Nathan Salmon. Salmon invokes abstract artifacts as the referents of fictional names in both object- and meta-fictional discourse alike. He then invokes a theory of pretence to forge the requisite connection between object-fictional sentences and meta-fictional sentences, in virtue of which the latter can be assigned appropriate truth-values. I argue that Salmon's account of pretence renders his appeal to abstract artifacts as the referents of fictional names (...) in object-fictional discourse explanatorily redundant. I further argue that his account is therefore no improvement over those he criticises, thus leaving his own account unmotivated. (shrink)

Although data sharing is one of the primary measures proposed to improve the integrity and quality of published research, studies show it remains the exception not the rule. The current study examines the availability of data in papers reporting the results of analyses of empirical data from original research in high-impact addiction journals. Thirteen high-impact journals with data sharing policies were selected from those included in the substance abuse category of the 2018 Clarivate Analytics’ Journal Citation Report. The first 10 (...) full or short original research reports that included empirical data in the most recent complete issue of each journal were electronically searched and reviewed for reference to where their data can be obtained and for a formal data sharing statement. Only eight of the 130 papers contained a data sharing statement in their text or supplementary online materials, and just one contained a direct link to the data analyzed. Data sharing was rare in the 13 high-impact addiction journals reviewed. The nature of the data reported in addiction journals might partly explain this. Currently, data sharing is not a procedure likely to improve the quality and integrity of published addiction research. (shrink)

Is the human mind uniquely nonphysical or even spiritual, such that divine intentions can meet physical realities? As scholars in science and religion have spent decades attempting to identify a 'causal joint' between God and the natural world, human consciousness has been often privileged as just such a locus of divine-human interaction. However, this intuitively dualistic move is both out of step with contemporary science and theologically insufficient. By discarding the God-nature model implied by contemporary noninterventionist divine action theories, one (...) is freed up to explore theological and metaphysical alternatives for understanding divine action in the mind. Sarah Lane Ritchie suggests that a theologically robust theistic naturalism offers a more compelling vision of divine action in the mind. By affirming that to be fully natural is to be involved with God's active presence, one may affirm divine action not only in the human mind, but throughout the natural world. (shrink)

Jansen and Wall suggest a new way of defending hard paternalism in clinical research. They argue that non-therapeutic research exposing people to more than minimal risk should be banned on egalitarian grounds: in preventing poor decision-makers from making bad decisions, we will promote equality of welfare. We argue that their proposal is flawed for four reasons.First, the idea of poor decision-makers is much more problematic than Jansen and Wall allow. Second, pace Jansen and Wall, it may be practicable for regulators (...) to uncover the values that a potential research participant holds when agreeing to enter a research project, so their claim that we must ban such research projects for all if we are to ban them for poor decision-makers looks to be unmotivated. Third, there seem to be cases where the liberty to enter the sort of research project Jansen and Wall discuss is morally weighty, and arguably should outweigh concerns of egalitarian distribution. Fourth, banning certain types of research, which seem on the face of it to offer an unfavourable risk-benefit ratio, would have unwelcome consequences for all clinical research, which Jansen and Wall do not recognize.
